REQUEST FOR QUALIFICATIONS NO. 002-23-VI

The Virgin Islands Public Services Commission (“Commission” or “PSC”), No. 1003 Estate Ross, Suite 4, St. Thomas, U. S. Virgin Islands, 00802, invites submittal of Statements of Qualifications (QS) from qualified candidates.

Introduction

The Commission is seeking qualifications from highly qualified candidates to serve as Hearing Examiners to conduct hearings and formal dockets pertaining to regulated utilities matters. The Hearing Examiner reviews and interprets public utilities local and federal regulations, conducts hearings, and renders recommendations of an appropriate order or decision by the PSC. In addition, the Hearing Examiner may hold hearings and make recommendations on appeals of denials and/or approvals, decisions or determinations made by the Commission and reviews and hears other matters as provided for and applicable to the Virgin Islands Code.

The Commission will review qualifications and create a list of qualified on-call hearing examiners for each discipline of regulated utilities. The Commission is not seeking, or expecting, team responses or expertise in every aspect of each area. The Commission anticipates that all services will be on an as-needed or on-call basis.

The Virgin Islands Public Services Commission has regulatory jurisdiction over:

  1. telephone service;

  2. water supply services; except retail deliveries;

  3. electric power service;

  4. public marine passenger transportation services operating under government grant of exclusive franchise;

  5. waste management service provided by the Virgin Islands Waste Management Authority or any successor agency;

The Commission also provides:

  1. Eligible Telecommunications certifications and oversight for various FCC programs;

  2. Oversight of independent power generation through small power production, cogeneration and renewable energy;

  3. Cable television (to the extent not pre-empted by federal actions); and

  4. Cellular service issues.

Scope of Services

The services to be provided by the Hearing Examiner include:

  • Conducts hearings;

  • Rules upon offers of proof and receives relevant evidence;

  • Considers the written and supporting documents and evidence submitted, and recommendations, supporting documents and evidence presented at the hearing;

  • Determines credibility and substantiality of testimony, makes findings of fact and conclusion of law;

  • Prepares timely, clear, technically sound, accurate and comprehensive decision in matters heard containing findings and conclusions;

  • Conducts pre-hearing conferences for the settlement or simplification of the issues;

  • Performs legal research to prepare for hearings;

  • Drafts orders and other decisions as directed by the Commission;

  • Reports, orders, or decisions recommended by the Hearing Examiner to the Commission must be in writing and shall set forth separately findings of fact and conclusions of law; shall be filed with the Commission; and shall be served upon the Parties appearing in the proceeding.

Minimum Requirements

Hearing Examiners must meet the following minimum requirements in order to be considered responsive to this notice:

  • Five years experience as:

    • Attorneys;

    • Accountants;

    • Engineering; and/or

  • Specific applicable experience which must be described in your response.

One (1) electronic copy of the applicant’s statement of qualifications shall be submitted electronically to psc.info@psc.vi.gov or one (1) hard copy and an electronic media copy in enclosed in an envelope, sealed, addressed and mailed to the Office of The Executive Director, Virgin Islands Public Services Commission, P. O. Box 40, St. Thomas, VI 00804-0040 no later than 5:00 p.m. on Monday, October 9, 2023. The submittal should clearly be marked on envelopes and/or subject line “QUALIFICATIONS – HEARING EXAMINER.”
